Terms and Conditions of Sale
ARTICLE 1. PRODUCT & CONFORMITY
The company ALUGAMMA guarantees the insulating, thermal, and/or acoustic qualities of its joinery products. However, it cannot guarantee the same for the walls or surfaces on which the joinery is or will be installed. Given the specific nature of the products sold (custom-made), the displayed models, catalogs, and photos do not constitute binding price offers. All options and specifications of the product detailed in the quote will be included in the order confirmation, which is the sole binding document.
ARTICLE 2. ORDER
Upon signing the quote with the note “approved,” orders become irrevocable, signifying acceptance of these terms and conditions. The client agrees to pay a 50% deposit on the day the quote is approved via bank transfer. Any modification to the order must be approved by ALUGAMMA and will void previously agreed delivery timelines. Orders for custom-made items cannot be canceled. Information in the catalog is for guidance only. Any cancellation of an order or refusal to accept the delivered goods will result in the loss of the deposit already paid, which corresponds to 40% of the order amount. We reserve the right to cancel any order deemed unfeasible.
ARTICLE 3. PRICE
Prices are determined based on the costs of manufacturing materials and their variations, in compliance with current legislation. The prices invoiced are those in effect on the day the quote is approved, which is also the day the supplies are ordered. The quote provided to the client is free and valid for 15 days from its issue date. The ownership transfer of delivered goods is subject to full payment. If payment is not made within the agreed timeframe, ALUGAMMA reserves the right to reclaim the delivered goods.
ARTICLE 4. PAYMENT TERMS
The general terms specify that the client must pay a 50% deposit upon acceptance of the quote via bank transfer to ALUGAMMA. To trigger the delivery of the product(s), the client must pay the full order amount via bank transfer. In case of delayed payment, we will not proceed with the delivery of the order.
ARTICLE 5. DELIVERY & DEADLINES
The delivery times provided by ALUGAMMA are indicative. If these deadlines are exceeded despite our best efforts, the client cannot request order cancellation or delay compensation. As per Article 105 of the Commercial Code, the client is responsible for making reservations and filing claims with the carrier.
The client must inform ALUGAMMA of any potential access difficulties at the site and constraints to be observed for delivery (schedules, access codes, etc.). Once the delivery date has been accepted, the client agrees to be present or represented by someone of their choice to sign the delivery receipt.
ARTICLE 6. WARRANTY
The ALUGAMMA warranty covers manufacturing defects but does not cover issues resulting directly or indirectly from faulty installation, improper storage, or alterations made to our products. The warranty starts on the billing date and does not cover defects caused by improper maintenance. It is also void if our products are used with accessories not supplied by us.
Our products are covered by a 10-year warranty against lacquer defects, which must be visible under natural lighting.
- A 2-year warranty applies to motorized gate systems from the delivery date.
- A 5-year warranty applies to all products and accessories, including welds and assemblies between posts and crossbars on gates, from the delivery date.
If defective parts are identified, the warranty only covers their replacement; no additional compensation can be claimed. To benefit from the motorization warranty, the client must notify ALUGAMMA immediately via registered mail with acknowledgment of receipt, including photos of the defects.
The warranty does not apply in the following cases:
- Damage caused by external events
- Poor storage or installation conditions
- Electrical accidents or collisions
- Products modified or repaired by the client
For sales to professionals, they must inform their clients of the ALUGAMMA warranties. Any order or invoice changes must be communicated to ALUGAMMA. Warranty repairs or replacements do not extend the warranty period. The client cannot claim compensation for any reason, including personal injury, damage to unrelated property, or loss of earnings.
ARTICLE 7. DISPUTES
In case of disputes or disagreements regarding the interpretation of this contract, the Commercial Court of Trofa (Portugal) has exclusive jurisdiction, even in cases of multiple defendants or third-party claims.
ARTICLE 8. IMAGE RIGHTS
The client authorizes ALUGAMMA and its communication partner to photograph or reproduce their property featuring ALUGAMMA products in publications, catalogs, and advertisements without any formalities or compensation.
ARTICLE 9. GDPR
Under these terms, ALUGAMMA processes personal data of its clients and prospects as the data controller. We process data necessary for contract execution (invoicing, warranty management, etc.) or pre-contractual measures (quotes). To improve our services and products, ALUGAMMA may also use client data for brand communication, satisfaction surveys, claims handling, debt collection, and legal disputes.
ALUGAMMA may process personal data as required by law (accounting, GDPR rights). Data may be shared with our communication and IT providers, subcontractors, accountants, lawyers, and bailiffs when necessary.
Personal data is processed for a duration that does not exceed what is necessary for the purposes pursued, considering legal obligations and applicable rights prescription periods.
Clients and prospects have the following rights regarding their personal data:
- Right to access
- Right to correct errors
- Right to erase data
- Right to object to processing
- Right to request processing limitations
- Right to data portability
- Right to withdraw consent when required
